Terms of Service

1. Quotes and Agreements

Each project begins with a quote or proposal describing the work, price, and estimated timeline. If a written quote, proposal, or invoice for your project conflicts with these Terms, the project-specific document controls for that project. Prices shown on this website are subject to change and are confirmed in your quote.

2. Pricing and Payment

• Most projects are billed at a fixed fee. Work outside the original project scope is billed hourly at our current rate.
• Website maintenance is available as a monthly plan (Basic care $67.99/month, Standard business $148/month, or E-commerce / high-traffic from $381/month) or at $45.00/hour with a 1-hour minimum. Work beyond what your monthly plan covers is billed at $45.00/hour with a 1-hour minimum.
• Payment amounts, deposits, and due dates are stated on your quote or invoice. We may pause work on accounts with overdue balances.
• Unless stated otherwise, prices do not include third-party costs such as domain names, hosting, premium plugins, stock photography, or postage, which are billed separately.

3. Timelines and Your Responsibilities

On average, websites are delivered within 1–2 weeks after we receive your content, design work within about a week, and print orders within 7 days or less depending on quantity. These are estimates, not guarantees. Timelines depend on you providing content, branding assets (logo, fonts, colors), feedback, and approvals promptly; changes, additions, or delays in content will extend the schedule.

You are responsible for making sure that all content you provide (text, images, logos, and other materials) is accurate and that you have the right to use it. You agree to hold us harmless from claims arising from materials you provide.

4. Revisions

Website designs and graphic designs include two rounds of revisions. Additional revisions or changes after approval are billed at our current hourly rate.

5. Proofs and Printing

• Printed orders have a minimum of 100 copies, sets, and/or pieces.
• You will receive a proof before printing. Once you approve a proof, you accept responsibility for its content, including spelling, wording, and layout.
• Colors may vary slightly between screens, proofs, paper stocks, and printing methods (offset or digital). Minor color variation is not considered a defect.
• Customer-supplied files should be print-ready, ideally in Acrobat .pdf format. We are not responsible for issues caused by files that are not print-ready.

6. Ownership of Work

Once your project is paid in full, you own the final approved design files and website content created specifically for you. Until full payment is received, all work remains the property of Influx Studios. Third-party elements (such as fonts, stock images, themes, plugins, or software) remain subject to their own licenses. We may display completed work in our portfolio and marketing (such as our “Selected Works” section) unless you ask us in writing not to.

7. Website Maintenance Services

Maintenance plans include ongoing content updates, technical support, software and security updates, SSL certificate maintenance, and backups, as described on our website. Maintenance plans renew monthly until cancelled. See our Refund & Cancellation Policy for how to cancel.

8. Hosting and Third-Party Services

Websites often rely on third-party services such as hosting providers, domain registrars, WordPress, and plugins. We are not responsible for outages, changes, or failures of third-party services, although we will help resolve issues as part of an active maintenance plan or at our hourly rate.

9. Promotions and Giveaways

From time to time we may offer sales, discounts, or giveaways to members of our Sales & Discounts Notification List. Each promotion will have its own rules and eligibility requirements, which will be provided when the promotion is announced. No purchase is necessary to enter any giveaway, and promotions are void where prohibited.

10. Use of This Website

You agree not to misuse this website, including by submitting false information, sending spam through our forms, attempting to gain unauthorized access, or interfering with the site’s operation. All website content, including text, graphics, logos, and portfolio images, belongs to Influx Studios or its clients and may not be copied without permission.

11. Warranties and Limitation of Liability

We perform our work with care and professional skill. Except as expressly stated in these Terms, our website and services are provided “as is,” without other warranties of any kind. To the fullest extent permitted by law, Influx Studios will not be liable for indirect, incidental, or consequential damages, including lost profits or lost data, and our total liability for any claim related to a project will not exceed the amount you paid us for that project.

12. Termination

Either party may end a project by written notice. You will be responsible for payment for work completed through the termination date, as described in our Refund & Cancellation Policy.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Kent County, Michigan.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they were last revised. Changes do not affect projects already under a signed quote or agreement.
